Website terms of use
The rules for using tiercommerce.com. Using the TierCommerce platform itself is covered by a separate customer agreement.
About these terms
These terms apply to tiercommerce.com, which Digital Bird Pty Ltd operates. In these terms, “we” and “us” mean Digital Bird Pty Ltd. By using the site, you agree to these terms.
If your business subscribes to TierCommerce, the customer agreement you sign governs the platform. Where the two differ, the customer agreement applies.
Information on the site
The site gives general information about TierCommerce. It isn’t professional, legal or financial advice for your business.
We work to keep it accurate and up to date. But the product changes, and so do the systems it connects to. A feature or integration described on the site as coming or planned isn’t a commitment until it’s written into your agreement with us.
Comparisons with other products
Our comparison pages compare TierCommerce with other products using information those vendors have published. Each page shows the date we checked it and links to our sources. Other products change, so check with the vendor before you decide.
If you think something on a comparison page is wrong or out of date, email [email protected]. We’ll check it and correct it if it’s wrong.
Other products’ names, logos and trademarks belong to their owners. Mentioning them doesn’t mean those owners endorse TierCommerce or are connected with us.
Pricing and quotes
Prices on our pricing page are starting prices in Australian dollars, excluding GST. Other plans are quoted individually, because trade accounts, systems and customisation vary so much. Nothing on the site is an offer to sell at a particular price. A price is only binding once it’s in a written quote or agreement from us.
Our content
We own the text, design, graphics and code on the site, or we have permission to use them. You’re welcome to read, print and share links to pages for your own business. Please don’t copy or republish substantial parts of the site without asking us first.
Logos of the businesses our team has built B2B ecommerce for appear with those businesses’ permission. They remain the property of those businesses.
Using the site
When you use the site, please don’t:
- use it for anything unlawful
- try to get into parts of the site or our systems that aren’t public, or interfere with how they work
- copy the site with automated tools at a volume that affects how it works for others
- send us false information, or someone else’s details without their permission
- upload or send anything that contains malicious code
If you find a security problem with the site, email [email protected]. Please give us a chance to fix it before you tell anyone else.
Other websites
The site links to other websites, such as our sources, our implementation partner and the systems we integrate with. We don’t control those sites and aren’t responsible for their content or their privacy practices.
Your consumer rights and our liability
Nothing in these terms takes away rights you have that the law says can’t be excluded. These include your rights under the Australian Consumer Law and, in New Zealand, under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
Apart from those rights, we provide the site free of charge and as it is. As far as the law allows, we aren’t liable for any loss that comes from using the site or relying on information on it. Where our liability can be limited but not excluded, it’s limited to supplying the information again.
Governing law
These terms are governed by the law of Queensland, Australia. You and we both agree to the jurisdiction of the courts of Queensland.
Changes to these terms
We may update these terms from time to time. When we do, we’ll change the date at the top of this page. The version on this page when you use the site is the one that applies.
